In consideration of the undersigned participant's (Participant) participation in or use of the Energy Enhancement System (EESystemTM) as made available by Scalar Wellness Center LLC (Scalar Wellness), Participant acknowledges and agrees as follows: 

Acknowledgements

1. All content, including any text, graphics, images, videos, and/or other information media provided at the office or contained on the Scalar Wellness website. (https://www.scalarwellnesscenter.com/) and its social media outlets, is for general information and education. purposes only. 

2. Any information offered whether in person or through the Scalar Wellness website about EESystemTM and/or any other subject is not intended or implied to be a substitute for professional medical advice, diagnosis or treatment. 

3. Scalar Wellness is not a health care provider and EESystemTM is not a health care modality. 

4. Neither Scalar Wellness nor EESystemTM is dispensing medical advice, prescribing medication or a course of treatment, or offering to treat, cure, prevent, or diagnose disease or illness. 

5. Scalar Wellness does not recommend, endorse, or make any representation about the appropriateness or suitability of the EESystemTM to provide any particular or specific outcome. 

6. The EESystemTM as made available through Scalar Wellness is not a medical treatment of any kind, and constitutes merely a voluntary session offered for relaxation purposes only. 

Assumption of Risk 

1. Participant is responsible for evaluating the risks that Participant may face while participating in the EESystemTM and agrees that such participation shall be considered to have been undertaken with the Participant's approval and understanding of any and all risks involved. 

2. Participant is responsible to confirm any information. obtained from or through the Scalar Wellness website. with other sources and review all information regarding medical condition or treatment with Participant's physician. any 

3. Participant is not relying on Scalar Wellness or any information offered by it, whether in person or through the Scalar Wellness website, to diagnose or treat a health care concern, disease, symptom, or the like. 

4. Participant will not disregard professional medical advice or delay seeking medical treatment based upon anything Participant has read, heard, or obtained from Scalar Wellness or through the Scalar Wellness website.

Waiver of Liability 

Participant, on behalf of Participate and Participant's minor. charges, heirs, executors, successors, and assigns, hereby REMISES, RELEASES, and FOREVER DISCHARGES Scalar Wellness from: 

1. any and all claims arising out of or in any way relating to Participant's participation in or use of the EESystemTM: 

2. any responsibility for any accident, illness, injury, death or any other damage caused by, arising from, or in any way relating to Participant's participation in or use of the EESystemTM; and 

3. any liability, damage, or injury caused in whole or in part by the intentional misconduct or negligent acts or omissions of any other participant using the EESystemTM or any other third-party. 

Participant further RELEASES and agrees that they will not sue Scalar Wellness for money damages, personal injury or property damage sustained by the Participant participating in or using the EESystemTM.

 Indemnification and Hold Harmless 

Participant agrees to defend, indemnify and hold Scalar Wellness harmless from any and all claims, lawsuits or demands made by anyone arising from or relating to the Participant's participation in or use of the EESystem TM.

Code of Conduct/Adherence to Standards 

Participant understands and agrees: 

1. By participating in the EESystemTM, Participant is subject to the rules and regulations of Scalar Wellness; 

2. Participant will not engage in inappropriate conduct, abuse of the customs or mores of the community, or any form of mistreatment of other participants and/or Scalar Wellness personnel; 

3. Participant will obey all directives issued by Scalar Wellness personnel; and 

4. If Participant's conduct should cause him/her to be removed from participation in or use of the EESystemTM, Scalar Wellness shall not be required to make any refund.
